outlets, and are subject to terms and conditions as detailed on this web site.

CHANGES TO DELIVERY SCHEDULE10.1 Should any changes to the delivery schedule become known to us then we shall communicate those changes to you as quickly as possible. 10.2 Although we make all efforts to give realistic delivery dates and avoid delays in delivery we accept no liability for delays caused by circumstances that are beyond our control. Where product is sourced overseas the Shipping Agents and Customs clearance processes can be subject to delays particularly at times of capacity constraint such as Christmas. 11. ORDER CANCELLATION11.1 If you wish to cancel the order then we shall assess the situation with our
Suppliers and if the product can be allocated to another customer or outlet
then we shall offer this solution to you. However should this be an alternative
then there would be a charge for handling costs and administration fees. In the
event that the product is deemed customised to you thus limiting the
opportunity for re sale then we reserve the right to reject the cancellation
request.
11.2 If you wish to cancel the order due to a problem with merchant quality of the product and where we have not been able to repair or replace within reasonable time then again we must receive your request in writing within 30 days of the date of collection or delivery. 11.3 If a cancellation is agreed, you must return the goods to us at your cost unless the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return. In this case we will nominate the carrier. 12. DELIVERY & TITLE12.1 Unless instructed accordingly we will deliver the product in accordance with your order. A valid signature will be required on collection or delivery. Immediately prior to despatch of the product to you, title in the product will pass to you.In the event that you have not received all the goods within 21 days of the date of delivery you must notify us immediately. 13. ON SITE SERVICES13.1 For larger product such as spas, saunas etc we shall require sufficient access to the installation area and you need to be aware that any additional handling costs such as crane hire etc that may be necessary shall be your responsibility. Such costs shall be payable prior to completion of the service. 13.2 You will be solely responsible for any damages caused as a result of giving instructions to any of our agents or operatives except to the extent that the persons performing the services are negligent. 13.3 If any Services are delayed, postponed and/or are cancelled due to you failing to comply with its obligations. You will be liable to pay additional charges unless the delay is due to Force Majeure. 14. LIABILITYIf you have notified us of a problem with the goods, we may elect to either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative
inconvenience, disappointment, indirect or consequential loss or damage arising
out of any problem in relation to the goods and we shall have no liability to
pay any money to you by way of compensation other than any refund we make under
these conditions.
15. FORCE MAJEUREWe shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered under circumstances outside of reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, sub-contractors, importation delays, lock-outs, riots, civil commotion, malicious damage, explosion, terrorism, governmental actions and any other similar events. 16. TERMINATION OF CONTRACTWe reserve the right to suspend supply or delivery, stop any product in transit
or terminate our contract by notice in writing to you if you are in material
breach to our terms and conditions.
17. GOVERNING LAWThis Contract is governed by and interpreted in accordance with English law and the parties agree to submit to the non-exclusive jurisdiction of the English courts. 18. DISCLAIMERS18.1. Images contained within advertising brochures or the web site are for illustration purposes only; We reserve the right to change without notice. 18.2 Colours and specifications may vary from those depicted. 18.3 We reserve the right to amend pricing at our own discretion. 18.4 We shall make all efforts to avoid omissions or mistakes contained within this web site, however such errors may occur from time to time and these shall be remedied without liability. 18.5.
